ORDINANCE on the requirements for the labeling and presentation of foodstuffs


Adopted by the Council of Ministers № 383 of 4.12.2014, promulgated, SG, no. 102 of 12.12.2014, in force from
12/13/2014
Art. 1. The ordinance determines the requirements for:
1. the labeling, presentation and advertising of foodstuffs in order to ensure:
the right of users of information;
2. the presentation of nutrition information in food labeling,
including in the case of food claims.
Art. 2. Foods shall be labeled in accordance with the requirements of Regulation (EU) (
Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011
information on consumer food, amending regulations (EC) (
1924/2006 and (EC) № 1925/2006 of the European Parliament and of the Council and repealing
Commission Directive 87/250 / EEC, Council Directive 90/496 / EEC, Directive
1999/10 / EC of the Commission, Directive 2000/13 / EC of the European Parliament and of the Council,
Commission Directives 2002/67 / EC and 2008/5 / EC and Regulation (EC) No 608/2004
Commission (OJ L 304, 22.11.2011), hereinafter referred to as "Regulation (EU)"
1169/2011 ".
Art. 3. In accordance with Art. 15 (2) of Regulation (EU) (1169/2011
the information on the label is presented in Bulgarian.
Art. 4. The declaration of nutritional value in food labeling shall be
carried out in accordance with the requirements of Chapter IV, Section 3 of Regulation (EU) (
1169/2011.
Art. 5. When labeling food, in addition to the data under Art. 9 of Regulation (EU) (
1169/2011 must indicate the marking, allowing the identification of
the batch to which the food belongs.
Art. 6. The nutrition and health claims and the conditions for their presentation shall be
determined in accordance with Regulation (EC) № 1924/2006 of the European Parliament and of the Council of
20 December 2006 on nutrition and health claims made on foods (OJ, Special
2007 edition, Chapter 15, Volume 18).
Art. 7. The use of generic designations (names) of foods is carried out
in accordance with Commission Regulation (EC) (907/2013 of 20 September 2013 on
laying down rules on applications for generic applications
designations (OJ L 251 of 21.09.2013).
Art. 8. Indication of the country of origin or place of provenance for fresh,
chilled or frozen meat of pigs, sheep, goats and poultry is carried out in
in accordance with Commission Implementing Regulation (EU) № 1337/2013 of 13 December
2013 laying down rules for the implementation of Regulation (EU) № 1169/2011 of
European Parliament and of the Council on the indication of the country of origin or
place of origin for fresh, chilled or frozen meat of pigs, sheep, goats and
poultry (OJ L 335, 14.12.2013).
Art. 9. When labeling foods containing coloring matters listed in Annex
V of Regulation (EC) № 1333/2008 of the European Parliament and of the Council of 16 December
2008 on food additives (OJ L 354, 31.12.2008) is inserted
the additional information specified in this Annex.
Art. 10. (1) When labeling new foods and food ingredients shall be observed and
the requirements of art. 8 of Regulation (EC) № 258/97 of the European Parliament and of the Council
on novel foods and novel food ingredients (OJ L 43, 14.2.1997).
(2) When labeling foods and food ingredients that contain or are
composed of genetically modified organisms (GMOs), or have been produced, or
contain ingredients produced from GMOs, the requirements of Art. 12 and 13 of
Regulation (EC) No 1829/2003 of the European Parliament and of the Council on genetic engineering
modified food and feed (OJ L 268, 18.10.2003).
(3) In the labeling, presentation and advertising of foods intended for
people who have an intolerance to gluten, the requirements of Art. 3 of
Commission Regulation (EC) (41/2009 of 20 January 2009 on the composition and
labeling foods suitable for use by people who are intolerant to
gluten (OJ L 16, 21.01.2009), hereinafter referred to as Regulation (EC) № 41/2009, and
the requirements of Commission Implementing Regulation (EU) № 828/2014 of 30 July 2014.
on the requirements for providing information to consumers on
the absence or reduced content of gluten in foodstuffs (OJ L 228, 31.07.2014).
(4) In the labeling, presentation and advertising of foods, specified in art. 4 of
Regulation (EC) (41/2009, which, although not intended for people with intolerance
to gluten are suitable for consumption, the labeling requirements are met and
the conditions for gluten content, defined in art. 4 of Regulation (EC) № 41/2009, as
and the requirements of Commission Implementing Regulation (EU) № 828/2014 of 30 July 2014
on the requirements for providing information to consumers on
the absence or reduced content of gluten in food.
(5) Paragraphs 1 and 2 shall not apply to infant formulas and follow-on formulas falling within
the scope of the Ordinance on the requirements for the composition, characteristics and names of
infant formulas and follow - on formulas adopted by Decree № 312 of
The Council of Ministers of 2007 (promulgated, SG No. 110/2007; amended and supplemented, SG No. 37/2009,
no. 84 of 2013 and no. 28 of 2014).
Art. 11. (1) The batch of a given food shall be determined in each separate case by
the manufacturer or the person who packs the food or the first trader identified
within the European Union. The marking under Art. 5 is determined and designated according to
the obligation of these persons.
(2) The marking under art. 5 of the food is preceded by the spelling of the Latin
the letter "L" except where it is clearly distinguishable from the other indications on the label.
(3) In the case of group packages containing individual portions of ice cream,
the marking under Art. 5 shall be placed on the group packages.
(4) When the food is pre-packaged, the marking under art. 5 and where it is
where applicable, the letter "L" shall be placed on the prepackage or on an attached
to her label.
(5) When the food is not pre-packaged, the marking under art. 5 and where it is
where applicable, the letter "L" shall be placed on the package or container or, failing that
possible - in the relevant commercial documents.
(6) In the cases under par. 4 and 5 the marking under Art. 5 and the letter "L" must be printed
in such a way as to be easily visible, clearly legible and indelible.
(7) Labeling of the food lot is not required:
1. in the case of agricultural products which, after leaving the field:
(a) are sold or delivered to temporary storage, handling or
packaging;

(obn., DV, br. 107 ot 2002 g.; izm. i dop., br. 69 ot 2005 g., br. 15 i 75 ot 2007 g. i br. 47 i 86 ot 2010 g.), se zabranyavat: 1. izpolzvaneto na dumite "dietichna" ili "dieta" samostoyatelno ili v sŭchetanie s drugi dumi, opredelyashti tezi khrani; 2. vsichki drugi oznacheniya ili vsyako predstavyane, koito sŭzdavat vpechatlenie, che khranata e sŭs spetsialno prednaznachenie. DOPŬLNITELNI RAZPOREDBI § 1. (1) Po smisŭla na naredbata "partida" e grupa edinitsi za prodazhba ot dadena khrana, sŭzdadeni, proizvedeni ili opakovani pri prakticheski edni i sŭshti usloviya. (2) Za tselite na naredbata se prilagat i opredeleniyata ot reglamentite po § 3.  § 2. S naredbata se vŭvezhdat razporedbite na Direktiva 2011/91/ES na Evropeĭskiya parlament i na Sŭveta ot 13 dekemvri 2011 g. otnosno oznacheniyata ili markirovkite, identifitsirashti partidata, kŭm koyato prinadlezhi dadena khrana (OV, L 334 ot 16.12.2011 g.).  § 3. S naredbata se osiguryava prilaganeto na: 1. Reglament (ES) № 1169/2011 na Evropeĭskiya parlament i na Sŭveta ot 25 oktomvri 2011 g. za predostavyaneto na informatsiya za khranite na potrebitelite, za izmenenie na reglamenti (EO) № 1924/2006 i (EO) № 1925/2006 na Evropeĭskiya parlament i na Sŭveta i za otmyana na Direktiva 87/250/EIO na Komisiyata, Direktiva 90/496/EIO na Sŭveta, Direktiva 1999/10/EO na Komisiyata, Direktiva 2000/13/EO na Evropeĭskiya parlament i na Sŭveta, direktivi 2002/67/EO i 2008/5/EO na Komisiyata i na Reglament (EO) № 608/2004 na Komisiyata; 2. Reglament (EO) № 1924/2006 na Evropeĭskiya parlament i na Sŭveta ot 20 dekemvri 2006 g. otnosno khranitelni i zdravni pretentsii za khranite; 3. Reglament (EO) № 1333/2008 na Evropeĭskiya parlament i na Sŭveta ot 16 dekemvri 2008 g. otnosno dobavkite v khranite; 4. Reglament (EO) № 258/97 na Evropeĭskiya parlament i na Sŭveta otnosno novi khrani i novi khranitelni sŭstavki; 5. Reglament (EO) № 1829/2003 na Evropeĭskiya parlament i na Sŭveta otnosno genetichno modifitsiranite khrani i furazhi; 6. Reglament (EO) № 41/2009 na Komisiyata ot 20 yanuari 2009 g. otnosno sŭstava i etiketiraneto na khrani, podkhodyashti za upotreba ot khora, koito imat neponosimost kŭm gluten; 7. Reglament (EO) № 907/2013 na Komisiyata ot 20 septemvri 2013 g. za opredelyane na pravila otnosno zayavleniyata vŭv vrŭzka s izpolzvaneto na generichni oboznacheniya (naimenovaniya); 8. Reglament za izpŭlnenie (ES) № 1337/2013 na Komisiyata ot 13 dekemvri 2013 g. za opredelyane na pravila za prilaganeto na Reglament (ES) № 1169/2011 na Evropeĭskiya parlament i na Sŭveta otnosno posochvaneto na stranata na proizkhod ili myastoto na proizkhod za pryasno, okhladeno ili zamrazeno meso ot svine, ovtse, kozi i domashni ptitsi; 9. Reglament za izpŭlnenie (ES) № 828/2014 na Komisiyata ot 30 yuli 2014 g. otnosno iziskvaniyata za predostavyane na informatsiya na potrebitelite otnosno ot·sŭstvieto ili namalenoto sŭdŭrzhanie na gluten v khranite. ZAKLYUCHITELNI RAZPOREDBI § 4. Kontrolŭt po izpŭlnenieto na iziskvaniyata na naredbata se osŭshtestvyava ot organite na ofitsialniya kontrol po Zakona za khranite. § 5. Naredbata se priema na osnovanie chl. 10, al. 4 ot Zakona za khranite.

packed at the request of the buyer, or pre-packed for immediate
use;
3. on packages or containers, the largest side of which has an area of ​​up to 10 cm2;
4. on individual portions of ice cream.
(8) Where the period of minimum durability or the indication is placed on the label
"USE BEFORE" followed by a specific date is not required
the marking under Art. 5, provided that the date contains at least an uncoded indication of the day
and the month in that order.
Art. 12. When labeling, presenting and advertising foods that are not
special purpose foods within the meaning of the Ordinance on the requirements for
foods for special purposes, adopted by Decree № 249 of the Minister
Council of 2002 (promulgated, SG No. 107/2002; amended and supplemented, SG No. 69/2005, SG No. 15 and 75 of
2007 and no. 47 and 86 of 2010), the following are prohibited:
1. the use of the words "dietary" or "diet" alone or in combination with
in other words, defining these foods;
2. any other indications or representations which give the impression that
the food is for a special purpose.
ADDITIONAL PROVISIONS
§ 1. (1) In the sense of the ordinance "lot" is a group of units for sale by a given
food created, produced or packaged under virtually the same conditions.
(2) For the purposes of the ordinance the definitions of the regulations under § 3 shall also apply.
§ 2. The ordinance introduces the provisions of Directive 2011/91 / EU of
European Parliament and of the Council of 13 December 2011 on the designations or
the markings identifying the lot to which a food belongs (OJ, L
334 of 16.12.2011).
§ 3. The ordinance ensures the application of:
1. Regulation (EU) № 1169/2011 of the European Parliament and of the Council of 25
October 2011 on the provision of food information to consumers, for
amending Regulations (EC) № 1924/2006 and (EC) № 1925/2006 of the European
Parliament and of the Council and repealing Commission Directive 87/250 / EEC, Directive
90/496 / EEC of the Council, Commission Directive 1999/10 / EC, Directive 2000/13 / EC of the
European Parliament and of the Council, Commission Directives 2002/67 / EC and 2008/5 / EC and
Commission Regulation (EC) (608/2004;
2. Regulation (EC) (1924/2006 of the European Parliament and of the Council of 20
December 2006 on nutrition and health claims made on foods;
3. Regulation (EC) (1333/2008 of the European Parliament and of the Council of 16
December 2008 on food additives;
4. Regulation (EC) No 258/97 of the European Parliament and of the Council on new regulations
foods and novel food ingredients;
5. Regulation (EC) (1829/2003 of the European Parliament and of the Council on
genetically modified food and feed;
6. Commission Regulation (EC) № 41/2009 of 20 January 2009 on the composition and
labeling foods suitable for use by people who are intolerant to
gluten;
7. Commission Regulation (EC) (907/2013 of 20 September 2013 establishing the standard import values ​​for determining the entry price
rules on applications for the use of generic labels
(names);
8. Commission Implementing Regulation (EU) № 1337/2013 of 13 December 2013 on
laying down rules for the implementation of Regulation (EU) № 1169/2011 of the European
Parliament and of the Council on the indication of the country of origin or place of
origin for fresh, chilled or frozen meat of pigs, sheep, goats and poultry;
9. Commission Implementing Regulation (EU) № 828/2014 of 30 July 2014 on:
the requirements for providing information to consumers on absence or
reduced gluten content in food.
FINAL PROVISIONS
§ 4. The control over the fulfillment of the requirements of the ordinance shall be carried out by
the bodies of official control under the Food Act.
§ 5. The ordinance is adopted on the grounds of art. 10, para. 4 of the Food Act.
